Anthropic has released Fable 5, its most advanced AI model to date, now available in Harvey's platform for early access users. Fable 5 sets new benchmarks in legal AI performance but introduces nuanced data privacy and processing considerations that users need to evaluate.
The model achieved a record-breaking 13.3% on Harvey’s Legal Agent Benchmark (LAB), surpassing its predecessor, Opus 4.8, which scored 10.4%. LAB measures the model's ability to handle end-to-end complex legal tasks, with Fable 5 excelling particularly in drafting and long-horizon tasks such as analyzing multi-document scenarios and identifying inconsistencies in legal redlines. Additionally, it scored 93.4% on Harvey's proprietary BigLaw Bench, underscoring its capabilities in producing well-structured legal documents across diverse practice areas.

However, the model’s performance was noted to be mixed in areas like complex quantitative tasks, such as fund waterfall modeling and multi-step tax calculations, highlighting ongoing challenges even for top-tier AI.
Data Privacy Trade-Offs
While the technical achievements are impressive, Fable 5’s deployment raises critical questions about data handling. Unlike existing Harvey models, Fable 5 involves data retention practices by Anthropic, including potential access to inputs, outputs, and documents for safety reviews. Although Anthropic commits to deleting most data within 30 days, exceptions may occur for legal or safety reasons. Additionally, all data is processed in the United States, with no regional processing options available.
To address these concerns, Harvey has made Fable 5 an opt-in feature rather than the default setting. This approach allows organizations to decide whether the capabilities outweigh the privacy trade-offs based on their specific risk tolerance and compliance needs.
